These Terms of Service ("Terms") govern your access to and use of the Intero mobile application (the "Application"), and any related services, features, and content (collectively, the "Service") provided by Intero ("we," "us," or "our").
PLEASE READ THESE TERMS CAREFULLY. THEY INCLUDE A MANDATORY ARBITRATION PROVISION AND A CLASS ACTION WAIVER THAT REQUIRE THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS.
By creating an account, accessing, or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Service.
1. CRITICAL MEDICAL DISCLAIMER
Intero is Not a Medical Device and Does Not Provide Medical Advice.
The Service, including all data, assessments, text, graphics, and other material, is for informational, tracking, and educational purposes only. It is a tool to help you organize and track your personal health information to facilitate conversations with your healthcare provider.
The Service is NOT a substitute for professional medical advice, diagnosis, or treatment.
- Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.
- Never disregard professional medical advice or delay in seeking it because of something you have read or interpreted from the Intero Service.
- If you think you may have a medical emergency, call your doctor, go to the nearest hospital, or call emergency services immediately. Reliance on any information provided by Intero is solely at your own risk.
2. Eligibility
You must be 18 years of age or older to create an account and use the Service. By creating an account, you represent and warrant that you are at least 18 years old.
3. User Accounts
(a) Account Creation: You must register for an account to access the Service. You may register using your existing Google account or by using Sign in with Apple (collectively, "Third-Party Authentication"). By using Third-Party Authentication, you authorize us to access and use certain account information from the respective service, such as your name and email address, to create and manage your Intero account. You agree that all information you provide to us through these services is accurate, complete, and current.
(b) Account Security and Responsibility: Your Intero account is protected by your Google or Apple account. You are solely responsible for maintaining the security of your Google and/or Apple account credentials. Intero does not store a separate password for your account. All activities that occur under your Intero account are your responsibility. You agree to notify us immediately at support@interoai.com if you become aware of any unauthorized use of your Intero account or suspect a security breach related to your linked Google or Apple account.
(c) Third-Party Dependency: Your access to the Service is dependent on the availability and status of your Google or Apple account. We are not liable for your inability to access the Service due to any issues with your Third-Party Authentication provider (e.g., a suspended account or forgotten password).
4. Subscriptions and Payments
(a) Subscriptions: The Service requires a paid subscription. Subscriptions are available on an annual basis and will automatically renew unless you cancel.
(b) Billing: You will be billed in advance on a recurring basis. By providing a payment method, you authorize our third-party payment processors (Apple or Google) to charge you the subscription fee.
(c) Cancellation: You may cancel your subscription renewal at any time through your account settings in the Apple App Store or Google Play Store. The cancellation will take effect at the end of your current billing period.
(d) No Refunds: Subscription fees are non-refundable except as required by law.
(e) Fee Changes: We reserve the right to change subscription fees with reasonable prior notice.
5. Privacy and Data Usage
Your privacy is paramount. Our collection and use of your personal and health information are governed by our Privacy Policy.
(a) Anonymized and Aggregated Data: You grant us the right to anonymize and aggregate your data. We use this anonymized data for research, statistical analysis, and to improve the Service. This data cannot be linked back to you and may be retained by us even after your account is deleted.
6. Third-Party Integrations
The Service may allow you to connect and pull data from services like Apple Health and Google Fit ("Third-Party Services"). By connecting a Third-Party Service, you grant us permission to access and use your information from that service. We are not responsible for the privacy or security practices of any Third-Party Service.
7. SMS Text Messaging Program
By providing your mobile phone number and opting in, you agree to receive recurring automated SMS/text messages from Intero or on our behalf regarding your use of the Service, including daily health check-in reminders, account verification codes, and service-related notifications.
- Message frequency varies based on your settings and usage.
- Message and data rates may apply.
- You may opt out at any time by replying STOP to any message. After opting out, you may receive a one-time confirmation message.
- Reply HELP for help or contact support@interoai.com.
- Carriers are not liable for delayed or undelivered messages.
- Consent to receive SMS is not a condition of purchase of any goods or services.
SMS delivery is provided through our messaging service provider, Twilio. Your phone number and message content are handled in accordance with our Privacy Policy. We do not sell your phone number or share it with third parties for their marketing purposes.
8. Intellectual Property
The Service and its original content, features, and functionality are the exclusive property of Intero and its licensors, protected by copyright, trademark, and other laws of the United States.
9. Termination
We may terminate or suspend your account immediately, without prior notice, for any reason, including a breach of these Terms. Upon your request to delete your account, your personally identifiable health data will be permanently deleted. Anonymized and aggregated data may be retained.
10. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind.
11. Limitation of Liability
To the maximum extent permitted by law, Intero shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service.
12. Governing Law
These Terms shall be governed by the laws of the State of New York, United States.
13. Dispute Resolution by Binding Arbitration
(a) Agreement to Arbitrate: You and Intero agree to resolve any disputes through binding, individual arbitration, not in court.
(b) CLASS ACTION WAIVER: You and Intero agree to bring claims against each other only in an individual capacity, not as part of a class action.
(c) Rules: The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.
(d) Opt-Out: You may opt out of this arbitration agreement by emailing support@interoai.com within 30 days of first accepting these Terms.
14. General Terms
(a) Changes to Terms: We reserve the right to modify these Terms. For material changes, we will provide at least 30 days' notice.
